Google Spain - CJEU case (C-131/12): Google Spain's selling of advertising was 'inextricably linked' to the US search engine's processing, bringing it within the Directive (and now Article 3(1) logic).
In the CIPP/E body of knowledge, Google Spain comes up under Ch 17.5 - Search engines; Google Spain; Ch 5.2.1 - Establishment; IAPP Training · Module 8 - BoK V.D.
Google Spain in context
- It has shaped data protection through cases like [[Google Spain]], [[Schrems]] and [[Schrems II]]. (Court of Justice of the European Union (CJEU))
- Key cases: [[Weltimmo]] (broad establishment) and [[Google Spain]] (the 'inextricable link' test). (Article 3(1): EU-established controllers and processors)
- In ==Google Spain==, the CJEU held a search engine is a ==controller== of personal data on the third-party pages it indexes, and that Google Inc.'s processing was caught by EU law because it was =='inextricably linked'== to Google Spain's ad-selling activities. (Search engines and the right to be forgotten)
